The purpose of this form is to clearly state the terms agreed by both the landlord and the tenant (s) (“Resident”). If it is duly completed and signed by both parties, it will become a binding and legally enforceable contract. Two contracts are available: month-by-month lease (CA-040 form) and lease (CA-041 form). Forms 2.0/2.1: Lease (updated): This form has been revised to allow third-party rent payments, as required by amending California law. The section identifying the parties and the signature block have been revised to determine who should be identified as a lessor and who signs if the owner is represented by an agent. Other changes to the forms included: the agent`s accuracy for the service of the process and the person authorized to manage the property, deposit deadline options, payments before the transfer of ownership, consequences of the transfer, prohibition of fireworks, and allocation of tenant payments. The changes to the instruction include: information on the destruction of premises /tenant errors, right to inspection of balconies and bridges, as now provided by law, and provisions on electronic payments and mail payments.
